The Substance Abuse Professional (SAP) program is a federally regulated process that applies to safety-sensitive employees, including commercial drivers, who have violated DOT drug and alcohol regulations. The program ensures that these individuals receive proper evaluation, treatment, and education before they can return to duty. The DOT SAP evaluations are mandatory for drivers who violate drug or alcohol policies, and the return-to-duty process involves several regulated steps to ensure safety and compliance.
Steps in the Return-to-Duty Process
Violation Recorded: When a driver fails a drug or alcohol test, the violation is reported, and the driver is immediately removed from safety-sensitive duties.
SAP Evaluation: The driver must undergo an evaluation by a certified SAP. This evaluation can be conducted in person or via telehealth, depending on the provider's certification. The SAP assesses the driver's substance use and recommends a treatment or education plan if necessary.
Treatment or Education: Based on the SAP's recommendations, the driver must complete the prescribed treatment or education program. This step is crucial for ensuring the driver is fit to return to duty.
Follow-Up Evaluation: After completing the treatment, the driver returns to the SAP for a follow-up evaluation. The SAP will determine if the driver is ready to return to safety-sensitive duties.
Return-to-Duty Test: The driver must pass a return-to-duty drug and alcohol test. Only after passing this test can the driver resume safety-sensitive functions.
Follow-Up Testing: The driver will be subject to a minimum of six follow-up tests over the next 12 months to ensure ongoing compliance.

Timeliness: Drivers must complete their initial SAP assessment within 10 business days of a confirmed violation to avoid delays in reinstatement.
Telehealth Options: The DOT now endorses telehealth evaluations, increasing accessibility for drivers in remote areas.
Reporting Requirements: All SAP providers must report return-to-duty status and test results directly into the FMCSA Drug & Alcohol Clearinghouse by the end of the next business day.
